Refunds, Credits and Cancellations
At UpsideDownFlorida.com we pride ourselves on our customer service. We also believe if our service doesn't deliver you shouldn’t pay. That is why we DO NOT charge you for our service upfront unless we are successful in finding a solution to your mortgage problem as outlined in this working agreement. We do however charge a Non-Refundable Processing fee of $599 that covers all initial expenses, including initial assessment time incurred by UDF in effecting a Solution. Under no circumstances is this fee refundable and homeowner agrees NOT to dispute charge at any time. We offer 100% Customer Satisfaction and promise to deliver a solution that you are happy with or you don’t pay the Loss Mitigation Fee. It is that Simple! Additionally, if UDF performs as hired and the information provided by Homeowner is incorrect and/or insufficient, thus causing results not satisfactory to the intent of this Working Agreement, despite the best efforts of UDF, the Homeowner acknowledges and agrees there will be NO REFUND to the upfront processing fee.
Furthermore, as Homeowner has received valuable service in the initial assessment and application preparation, if Homeowner seeks independently a solution which UDF has been hired to perform, then Homeowner forfeits the full amount as compensation for services and agree there will be NO REFUND.
3. RESPONSIBILITIES: UDF will not be responsible if:
A. Homeowner fails to make payments or initial contribution towards arrears and/or fees as directed by the lien holder(s) in any reinstatement schedule negotiated by UDF.
B. Homeowner chooses not to comply with the results of UDF analysis there is NO REFUND.
C. Homeowner fails to provide UDF with all information and copies of documents requested in order to effect a Solution or if any of such information is later shown to be false or not supportable by independent documentation. Such documents include but are not limited to; complete and accurate Application and copies of two (2) months statements for all bank
accounts, proof of all income such as one (1) month’s worth of pay stub per mortgagor, rental agreements, or other proof of income, two (2) years’ Federal Tax returns with all W-2’s and 1099 forms, copies of all correspondence or documents concerning the current delinquency and any letter of reaffirmation or discharge or dismissal documents for any applicable bankruptcy or any other documentation that UDF or the mortgage company deems necessary. Should the Homeowner breach this responsibility, there will be NO REFUND.
D. Homeowner fails to maintain constant communication with UDF including but not limited to responding to phone calls or written communications within twenty-four (24) hours and causing to be delivered UDF any documentation requested by UDF within twenty-four (24) hours of it being requested. Homeowner is responsible to maintain access to a facsimile (FAX) transmission machine to documents can be rapidly transferred between Homeowner and UDF. UDF will maintain a record of all requests and attempts to contact Homeowner and will suspend all action on behalf of the Homeowner should the Homeowner fail to respond for any fourteen (14) day period. Because the success of effecting a Solution required prompt responses, should the Homeowner fail to uphold these standards of responsiveness, there is NO REFUND.
Homeowner agrees during the period covered by this Working Agreement and understands that, if contacted by lender, to explain that Homeowner has sought the advice of an office for loss mitigation services and Homeowner agrees not to compromise or may any agreement as such could inhibit UDF‘s ability to obtain a Solution or Homeowner forfeits the fee(s) as described above.
Homeowner understands that any correspondence received in connection to his/her mortgage must be immediately forwarded to our office during the loss mitigation process as follows:

· UDF does not provide legal advice or services regarding or responding to any court documents and an attorney should be consulted as to how to respond to court documents.
· Homeowner understands that any certified mail received during our involvement with the case must be claimed promptly.
· Homeowner has indicated that there is no sale date to foreclosure on the property named above. Homeowner understands that due to the amount of rapid action required to find a Solution on property about to be sold that UDF offers NO REFUND on property with a sale date within fourteen (14) business days or receipt of full fee.
· Homeowner has indicted that the mortgage debt is not under any current bankruptcy proceedings with the U.S. Bankruptcy court.
· Homeowner understands all claims for a refund must be made within ninety (90) days of enrollment.
